When you take your vehicle to a repair shop after an accident, how much say does your insurance company have in where you decide to take it? Unfortunately, many drivers don’t realize that the answer is none. Your insurance provider can recommend a shop, but you have the legal right to disregard that advice and go to a shop of your choosing. Here are some of the things your insurance company may tell you to try to convince you to ignore your own rights:
“We will only pay for the full repairs if you use our preferred shop.”
Your insurance company is obliged to pay regardless of which shop you have your vehicle repaired at. If they are refusing to pay the full costs of your repairs unless you agree to go to their preferred shop, they are in violation of the law.
“You can’t get quality repairs unless you go to our preferred shop.”
The truth is that you should take your vehicle to the shop that is most qualified to repair your vehicle. In many cases, insurance companies use their deals with their preferred shops to try to cut down on the amount of money they must pay their customers—by insisting that damaged parts be repaired rather than replaced, for example.
“We’ll be able to get to you faster if you use our preferred shop.”
If an insurance company tells you this, it’s simply a ploy to try to force you to use the shop they recommend. In other words, the delay is entirely created by your insurance provider. It has nothing to do with how quickly an auto shop will be able to repair your vehicle.
